ACADEMY OF PHYSICAL EDUCATION

INFORMATION CLAUSE FOR STUDENTS

 

In fulfillment of the obligation under Article 13(section 1) and (section 2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individual persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter referred to as 'RODO'), we inform you that:

1. The Administrator of your personal data is Academy of Physical Education in Katowice [72a Mikołowska street, 40 - 065 Katowice].

2. At Academy of Physical Education in Katowice a Data Protection Inspector has been appointed, who can be contacted via e-mail: iod@awf.katowice.pl

3. The Administrator collects and processes your personal data:
a) in order to implement the educational process and the student service during his/her studies at the Academy of Physical Education in Katowice. The basis for the processing of personal data in this regard is Article 6(section 1)(point c) of the RODO and Article 6(section 1)(point e) of the RODO in conjunction with the Act of 20 July 2018 The Law on Higher Education and Science and implementing regulations issued on the basis thereof, and in the case of persons who are obliged to submit medical certificates on the basis of generally applicable laws - also Art. 6(section 1)(point c) of the RODO in conjunction with Article 9(section 2)(point h) of the RODO in conjunction with the Ordinance of the Minister of Health of 26 August 2019 on medical examinations of candidates for secondary or higher schools and for qualifying vocational courses, pupils and participants of such schools, students, participants of qualifying vocational courses and doctoral students;
b) for the purpose of establishing, asserting or defending claims which the Administrator may raise or which may be raised against it. The above purpose constitutes a legitimate interest pursued by the Administrator. The basis for the processing of personal data in this regard is Article 6(section 1)(point f) of the RODO;
c) for the purpose of monitoring the careers of graduates, the purpose of which is to adapt the study program to the needs of the labour market. The basis for the processing is Article 6(section 1)(point c) of the RODO and Article 6(section 1)(point e) of the RODO in conjunction with Article 352 of the Act of 20 July 2028 of the Law on Higher Education and Science;
d) in the case of an application for financial assistance (social grant; grant for disabled persons; financial aid; Rector's grant; grant from the Minister of Science and Higher Education for students and outstanding young scientists), for the purpose of examining the application and possibly granting the benefit. The basis for the processing is Article 6(section 1)(point c) of the RODO and Article 6(section 1)(point e) of the RODO in connection with the Law on Higher Education and Science, and in the case of specific personal data (i.e. health data), additionally Article 9(section 2)(point b) of the RODO;
e) for other purposes where you have given your voluntary consent. The legal basis for the processing of personal data in this respect is Article 6(section 1)(point a) of the RODO.

4. Your personal data may be forwarded to the competent state administration authorities, entities cooperating with Academy of Physical Education in Katowice and processing personal data on the basis of a previously concluded agreement on the entrustment of personal data processing (in particular to hosting service providers), a law firm in the event of the need to establish, assert or defend claims which the Administrator may raise or which may be raised against him/her, entities in which the student will undergo internships, banks (only in the event of the payment of the benefit referred to in article 3(point d) above).

5. Your personal data will be processed:
a) for the duration of the course of study and for 50 years thereafter to the extent resulting from the provisions of generally applicable law, in particular the Act on Higher Education and implementing regulations issued on its basis, including Regulation of the Minister of Science and Higher Education of 27 September2018 on studies;
b) with regard to personal data processed for the purpose of adapting the study program to the needs of the market, for a maximum period of 10 years from the date of graduation;
c) in the case of personal data processed on the basis of your consent, until the purpose ceases or until you withdraw that consent.

6. Insofar as the processing of your personal data is carried out for the purposes of the educational process and student services, the provision of such data is a statutory requirement and necessary in terms of allowing the student to participate in the educational process. Failure to provide this data will prevent the provision of the benefit of participation in the educational process, i.e. the use of the Administrator's educational offer. In the case of personal data processed on the basis of consent, failure to give consent will result in your personal data not being processed for the purpose indicated in the consent clause.

7. The Administrator informs you that you have the rights:
a) to request from the Administrator access to your personal data;
b) where the personal data processed by the Administrator is inaccurate, you have the right to have it rectified, i.e. to request that it be amended or completed;
c) where your personal data is not needed by the Administrator for the purposes for which it was collected; where an objection has been lodged under the conditions described below; where the data should be erased in order to comply with an obligation arising from a legal provision, you have the right to request the Administrator to erase that personal data;
d) where you question the accuracy of the personal data, you may request the restriction of their processing for a period allowing the Administrator to verify the accuracy of the data;
e) In addition to the case indicated in point (d), you have the right to restrict the processing of your personal data when your personal data are unlawfully processed by the Administrator but you do not want the Administrator to erase them; when your data are not needed by the Administrator but may be needed to defend or assert your claims; or when you object to the processing of your data on the grounds described below until it is determined whether the legitimate grounds on the part of the Administrator override the grounds for the objection;
f) to request a transfer of the personal data you have indicated.
In order to exercise the above rights, please contact the Data Protection Officer directly (contact details as above).

8. If, in your opinion, the Administrator has violated the provisions on the protection of personal data, you have the right to lodge a complaint to the competent supervisory authority, i.e. the President of the Office for Personal Data Protection.

9. If your personal data are processed on the basis of your consent (Article 6(section 1)(point a) of the RODO), you have the right to withdraw it at any time, which, however, does not affect the lawfulness of the processing performed before the withdrawal of this consent. The declaration of withdrawal of consent can be addressed in writing in person, by letter or by email to the Data Protection Officer (contact details are indicated above).

10. You have the right to object to the processing of your personal data where the processing is carried out on the basis of a legitimate interest (Article 6(section 1)(point f) of the RODO) or in connection with the performance by the Administrator of a task carried out in the public interest (Article 6(section 1)(point e) of the RODO). In such a situation, the Administrator will no longer be able to process your personal data unless it has a valid legitimate basis for doing so, overriding your rights and freedoms or a basis for establishing, asserting or defending your claims. You may submit the objection in question directly to the Data Protection Officer (contact details as above).

11. Your personal data will not be transferred to countries outside the European Economic Area (unless you participate in the Erasmus + program, which will be implemented outside the EEA, in this case you will be informed accordingly about the processing of your personal data).

12. The personal data you provide will not be processed by automated means (i.e. without human intervention) and in particular will not be subject to profiling.
